This Warranty Disclaimer and Claim Policy (“Policy”) sets forth the terms, conditions, limitations, and procedures governing warranties offered by DNEA Pty Ltd (“DNEA,” “we,” “us,” or “our”) for all products supplied by DNEA, including but not limited to Wind Turbines, Controllers, Inverters, Solar Panels, Batteries, and Golf Cart Batteries. By purchasing and/or installing DNEA products, the customer (“Customer” or “You”) agrees to be bound by these terms.

1. WARRANTY COVERAGE AND DURATION

1.1 Wind Turbines

– DNEA warrants each Wind Turbine against defective materials and workmanship for a period of ten (10) years from the date of installation or delivery, whichever is earlier.
– This warranty is limited to repair or replacement of defective components, at DNEA’s sole discretion.

1.2 Controllers

– DNEA warrants Controllers against defects in materials and workmanship for a period of one (1) year from the date of purchase or installation.
– This warranty covers repair or replacement of defective Controllers, at DNEA’s sole discretion.

1.3 Inverters

– DNEA warrants Inverters against defects in materials and workmanship for a period of five (5) years from the date of purchase or installation.
– This warranty covers repair or replacement of defective Inverters, subject to the terms and conditions herein.

1.4 Solar Panels

– DNEA warrants Solar Panels against defects in materials and workmanship for twenty-five (25) years from the date of purchase or installation.
– This warranty does not cover physical damage such as broken or mishandled panels.

1.5 Batteries and Golf Cart Batteries

– DNEA warrants Batteries and Golf Cart Batteries against defects in materials and workmanship for five (5) years from the date of purchase or installation.
– Terms, conditions, and limitations set forth below apply.

Warranty Period: 5 years.

Terms and Conditions:

Batteries shall be repaired if possible.
If a battery cannot be repaired within 72 hours and the failure is determined to be a manufacturer fault, it will be replaced.
Exclusions apply to overloads, abuse, incorrect charging, or extreme discharge rates as determined by the SMART Battery Management System (BMS) built into the battery.

2. WARRANTY EXCLUSIONS AND LIMITATIONS

2.1 General Limitations
– Warranties are strictly limited to the repair or replacement of defective parts or units, and do not include labour charges, transportation, or any consequential damages.
– Warranties are void if the product has been tampered with, modified, or improperly installed.

2.2 Specific Exclusions

– Wind Turbines: No claims will be accepted if the Customer has not exercised proper due diligence to ensure that site conditions—specifically wind speed and wind strength—meet the specifications recommended by DNEA. Installation in an unsuitable location or inadequate wind conditions invalidates the warranty.
– Controllers: No claims will be entertained for damages caused by incorrect connection, high voltage, or improper wiring.
– Inverters: No claims will be accepted for damages resulting from misuse, abuse, high voltage, overload, or improper operation.
– Solar Panels: No warranties apply to panels that are physically broken, mishandled, or subjected to impacts or other physical damage.
– Batteries: The warranty does not cover damages resulting from overloads, abuse, incorrect charging procedures, extreme discharge rates, or use outside specified operating conditions.

Batteries are only repairable; if repair is not feasible within seventy-two (72) hours, a replacement will be provided for manufacturer faults or issues.

2.3 Overloads and Abuse

– All warranties are void if the product has been subjected to conditions beyond the manufacturer’s specified limits, including but not limited to excessive voltage, current overloads, physical destruction, or other misuse.

3. WARRANTY CLAIM PROCEDURE

3.1 Notification of Claim
– To make a warranty claim, the Customer must notify DNEA in writing within thirty (30) days of discovering the defect. The notification must include proof of purchase, relevant details of the defect, and any supporting evidence or photographs.

3.2 Inspection and Assessment
– DNEA reserves the right to inspect the product at its discretion to verify the defect and determine whether it is covered under warranty.
– The Customer shall cooperate and provide access to the product for inspection purposes.

3.3 Repair or Replacement

– If the claim is approved, DNEA will, at its sole discretion, repair or replace the defective product or component.
– If repair is not feasible within seventy-two (72) hours of acknowledgment, DNEA will replace the unit for manufacturer faults or issues, provided the product falls within warranty scope.

3.4 Costs

– The Customer is responsible for all shipping, transportation, and associated costs unless the claim is approved as a warranty defect thereby client shall send you our determined premises at their own cost and then DNEA Pty LTD shall make decision to cover cost or not to return to client.


4. DISCLAIMERS AND LIMITATION OF LIABILITY

4.1 No Other Warranties

– Except as expressly provided herein, DNEA disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for

Any other Products Manufactured / Supplied by DNEA shall fall in line with the stipulated Terms and Limitations of Liability. All Electrical units shall be the purchasers responsibility to have them installed in accordance to South African safety standards and Earthing Protection and full compliance certificate to be issued to DNEA Pty LTD for installations applicable. If no compliance certificate is available issued by a professional engineer Electrician DNEA Pty LTD shall have the warranties and liabilities null and void.

6. Limitations of Liability

DNEA disclaims all warranties, expressed or implied, including implied warranties of merchantability or fitness for a particular purpose, beyond the terms of this Warranty Disclaimer. Under no circumstances shall DNEA be liable for any indirect, incidental, or consequential damages arising from the use of its products.

7. Governing Law

This Warranty Disclaimer and Claim Policy shall be governed by and construed in accordance with the laws of [South Africa].

8. Amendments

DNEA reserves the right to amend this Warranty Disclaimer and Claim Policy at any time. Any changes will be communicated to Customers through appropriate channels.

9. All Goods remain Property of DNEA Pty LTD until fully paid for.

10. For refunds that are agreed on by DNEA Pty LTD a 15 % handling fee is applicable in all cases.
